BriteLift Terms and Conditions
Effective Date: January 1, 2024
BL Brokers, Inc. d/b/a BriteLift, Inc. (“BriteLift,” “we,” “our,” or “us”) is a transportation broker that operates a platform which facilitates the referral of individuals and organizations (“User,” “Users”), seeking a transportation provider, to independent, qualified Transportation Service Providers (“TSP,” “TSPs”). BriteLift, itself, is not a provider of any transportation services. By using our platform, which consists of a website, email, phone, and smartphone and tablet application, to obtain a referral of a TSP, you agree to the following Terms and Conditions. If you do not agree to these Terms, you may not access or use our services.
1. Definitions
For the purposes of these Terms and Conditions:
- “BriteLift” refers to BL Brokers, Inc. d/b/a BriteLift, Inc.
- “User” refers to any individual or organization using the BriteLift platform to facilitate a referral to a TSP.
- “Transportation Service Provider (TSP)” refers to an independent, third-party provider of transportation services that seeks referrals of transportation Users that utilize the BriteLift platform.
2. Services Provided by BriteLift
BriteLift serves solely as a broker, that operates a platform which facilitates the referral of Users to independent TSPs. BriteLift does not own or operate vehicles, nor does it employ drivers, and it does not provide any transportation services. BriteLift’s role is limited to operating a platform that can facilitate the referral of Users who utilize its platform to TSPs through a third-party dispatch service to which BriteLift’s platform communicates a User’s TSP referral request.
3. User Responsibilities
Users are responsible for providing accurate and complete information when requesting a TSP referral, including pickup and drop-off locations, times, and any additional service requirements. Users must notify us promptly of any changes to avoid disruptions. While utilizing BriteLift’s platform to facilitate a referral to a TSP, Users are solely responsible for complying with all applicable laws and regulations.
4. Transportation Service Providers (TSPs)
All transportation services brokered through the BriteLift platform are fulfilled by independent TSPs that contract with a third party dispatch service to which BriteLift’s platform communicates Users’ TSP referral requests. These TSPs are not employees, agents, subcontractors, or representatives of BriteLift, and they have no contractual relationship with BriteLift. They operate under their own name and on their own account as independent contractors and are solely responsible for maintaining their own insurance in compliance with applicable laws. BriteLift does not, and has no right to, control, manage, supervise, or evaluate the actions, policies, or practices of these TSPs.
5. Right to Refuse Service
BriteLift reserves the right to refuse service to any User at its sole discretion. Reasons for refusal may include, but are not limited to, the provision of inaccurate or incomplete information when using the BriteLift platform, excessive cancellations, or engagement in disrespectful, abusive, or illegal behavior, or violations of these Terms and Conditions. Refusal of service may be temporary or permanent and will be communicated to the User as deemed necessary.
6. Rates and Availability
Rates quoted at the time of a TSP referral request are based on the specific trip details provided by the User, including pickup and drop-off locations, time of service, number of stops, equipment rental, and any additional requirements. These rates are subject to adjustment if the service details change. The availability of transportation services is contingent upon the capacity and acceptance of TSPs at the time of a referral request being made or any time thereafter.
7. Booking, Cancellations, and Modifications
TSP referral requests are confirmed only after trip details are submitted and accepted by a TSP. Modifications to referral requests, including changes to locations, times, or additional service requirements, may result in additional charges and are subject to the availability of and acceptance by TSPs. Users may cancel TSP referral requests, but such cancellations may be subject to fees as outlined in our Cancellation Policy.
8. Payment Terms
Payment for transportation services brokered through BriteLift is due at the time a TSP referral request is submitted through the platform unless other terms have been prearranged. Payment processing is handled by third-party payment-processing firms utilized by the TSPs, and BriteLift is not responsible or liable for their operations or potential errors.
9. Insurance and Liability
TSPs are solely responsible for maintaining their own insurance policies in compliance with applicable federal, state, and local laws and regulations. BriteLift does not control or monitor the scope or adequacy of these policies. As a broker, BriteLift does not provide any insurance for the transportation services obtained through a referral facilitated by its platform and assumes no liability for accidents, incidents, or damages that may occur during such services.
10. Limitation of Liability
BriteLift is a broker that operates a platform which facilitates the referral of Users to TSPs through a third-party dispatch service to which BriteLift communicates Users’ TSP referral requests. BriteLift disclaims any responsibility or liability for the conduct, actions, or inactions of the TSPs, including but not limited to delays, accidents, personal injury, property damage, or other losses. The independent TSP responsible for providing transportation service to a User is responsible and liable for any claims related to such transportation services.
11. Corporate Bookings
Corporate Users are subject to additional terms. Monthly invoices will detail all rides and charges for the billing period, and payment is due within the terms specified in the agreement. Late payments may result in fees or denial of access to the BriteLift platform. Corporate accounts allow Users to manage bookings and view ride histories through our platform, and any misuse of this access may result in termination of privileges.
12. Coupons, Promotions, Promo Codes, and Rewards Program
BriteLift may, at its discretion, offer coupons, promotions, or promo codes to Users as part of marketing campaigns, loyalty initiatives, or other promotional efforts. These offers are subject to the following terms:
Coupons, promotions, and promo codes are subject to their stated terms and conditions, including applicable expiration dates, usage limits, and eligible services. They are non-transferable, have no cash value, and may not be combined with other offers unless explicitly stated. BriteLift reserves the right to revoke or modify any coupon, promotion, or promo code at its sole discretion and without prior notice, including in cases of misuse or suspected fraud.
Our rewards program allows Users to earn benefits based on eligible transportation services brokered through the BriteLift platform. Participation in the rewards program is subject to the terms and conditions. BriteLift reserves the right to modify or discontinue the rewards program at any time, including changes to earning rates, redemption methods, or the availability of rewards.
13. Changes to Terms and Conditions
BriteLift reserves the right to update and modify these Terms and Conditions at any time. Updates and modifications will be posted on our website, and continued use will constitute acceptance of any modifications.
